Terms of Service — McNeill’s Property Services

  1. Your Agreement with Us
    These Terms govern residential snow removal provided by McNeill’s Property Services (“Contractor,” “we,” “our”) to the customer (“Client,” “you,” “your”). By purchasing our service, you agree to these Terms.

  2. What “Snow Clearing” Includes
    “Snow clearing” means blowing or pushing accumulated snow from the described driveway/area to a permissible storage area on or directly adjacent to the property. We primarily use tractors with inverter blowers to help reduce surface impact and speed up service.

Not included unless specifically listed on your invoice/work order:
• Stacking or hauling snow off-site
• Sanding, salting, or chemical de-icing
• Hand shovelling of steps, walkways, or garage door lips

  1. Service Trigger & Timing
    • Service begins after ~5 cm (2 in) of accumulation.
    • Follow-up visits are included after municipal plows and during prolonged/heavy events when needed.
    • Timing varies by storm, route conditions, and safety. We may service your property at any time of day or night.

  2. Snow Storage
    If adequate storage space is not available on your property at any time during the season, you authorize us to store snow in reasonable areas beside the driveway or—if agreed with a neighbour—to use an adjacent area for temporary storage.

  3. Term & Seasonal Cap
    • Contract term: November 1 to April 15 of the current season.
    • Seasonal snowfall cap: 300 cm (10 ft) total accumulation.
    • If the season exceeds 300 cm, a proportional per-cm surcharge applies. Example: $599 ÷ 300 = $/cm, multiplied by the number of centimetres over 300.

  4. Vehicles & Access
    If vehicles or obstacles are present when we arrive, we will clear only accessible portions that open to the street. Route-based service requires safe access for equipment at the time of our visit.

  5. Client Responsibilities & Site Conditions
    • Remove items from the service area before each storm (bins, toys, cords, décor, sports nets, furniture, etc.).
    • Basketball nets must be turned or raised to at least 10 ft for safe clearance.
    • Remove or secure gutter downspout extensions before the season begins.
    • Raised water-main caps in the driveway should be tamped level with the surrounding surface (by you or the City).

  6. Surface & Property Limitations
    We are not responsible for damage to items left within the designated service area or to surfaces that are already heaved, chipped, uneven, rust-stained, or otherwise compromised (including asphalt, concrete, or interlock). Snow removal may leave packed snow/ice and slippery conditions; we are not responsible for icy conditions unless de-icing is purchased in writing.

  7. Safety, Liability & Waiver
    We provide snow removal only and do not guarantee a continuously bare, slip-free surface. To the maximum extent permitted by law, McNeill’s Property Services is not liable for slip-and-fall incidents or personal injury on the property. By opting for service, you waive, release, and discharge McNeill’s Property Services (including directors, officers, employees, representatives, agents, and subcontractors) from claims arising from snow or ice conditions and agree to indemnify and hold us harmless from such claims.

  8. Markers & Obstructions
    • We will install two markers near the street side of the driveway before the season.
    • You are responsible for additional markers around immovable objects (retaining walls, steps, ramps, raised patio stone, etc.).

  9. Exclusions
    • Snow from roof clearing, drifting beyond normal driveway accumulation, and ice removal due to freezing rain, sleet, or compaction.
    • Shovelling immediately in front of garage doors (where equipment cannot reach), front steps, and walkways—unless purchased as an add-on.

  10. Payment, Default & Cancellation
    • Payment is due as per your invoice terms.
    • If payment is not made or you breach these Terms, service may cease and the contract may be terminated without further liability.
    • If we are proven to be in breach, you may cancel and receive a refund of prepaid amounts for unrendered service.
    • On sale or re-occupation of the property, the contract is non-refundable but may be transferred to new occupants or (if within our active service area) to your new address.

  11. Route-Based Availability
    Snow service is route-based with limited spots per tractor. Availability is prioritized for Dorchester and immediate surroundings. Areas outside active routes may be placed on a waitlist.
